Recruitment Partners. Your Employers. AusPath Candidates & Onboarding.
These Terms explain the recruitment-partner split-fee model, purchased AI credits, candidate discovery and matching, protected introductions, and AusPath’s candidate checks and post-selection onboarding. Each accepted Job Order has its own agreed commercial terms.

AusPath Approval Means Something.
The AusPath Approved Recruiter badge is reserved for recruitment businesses that complete AusPath due diligence, remain in good standing and agree to follow defined candidate, employer and protected-workflow standards.
Tell Employers You’re an AusPath Approved Recruiter.
The AusPath Approved Recruiter badge is a trust signal that the recruitment business has passed AusPath’s current approval process and operates through the defined Recruiter Pro international recruitment workflow. It is not a government licence or guarantee of conduct, candidate suitability, sponsorship, migration or employment outcomes.
- Business due diligence before approval
- Ethical candidate handling and process requirements
- Access to the AusPath Recruiter Platform
- Access to the protected AusPath candidate ecosystem
- Structured employer and candidate workflows
- Employer-facing AusPath Approved Recruiter certification
Clear Responsibilities. Agreed Commercial Terms.
This summary is for convenience. The detailed clauses below govern the relationship.
AusPath Recruiter Platform Terms
Version 27 October 2026. Supplied by AusPath Agency Pty Ltd. Applies to new split-fee arrangements accepted under these Terms; existing accepted transactions remain governed by their applicable terms unless separately varied by agreement.
These Terms are commercial terms, not employment, migration, registration or legal advice. Nothing guarantees a candidate, employer, Job Order, placement, commencement, sponsorship, professional registration, skills assessment, migration eligibility, visa outcome, employer lead or revenue. Rights that cannot lawfully be excluded remain unaffected.
1. Agreement, authority and incorporated documents
By registering or using a recruiter workspace, accepting these Terms, buying or using AI credits, or entering an accepted Job Order agreement, the independent recruiter organisation (“Recruiter”, “you” or “your”) agrees to the applicable Terms. The person accepting confirms authority to bind the organisation.
These Terms incorporate the applicable checkout or order confirmation, published AI credit rules, Privacy Policy, candidate consent and visibility settings, and any accepted Job Order agreement or statement of work. A transaction-specific signed agreement controls for that transaction where it expressly differs from these general Terms. Marketing copy does not override an accepted checkout, consent screen or signed scope.
2. Registration, candidate discovery and verification
Recruiter organisations may register free and, within their approved workspace access, explore candidate categories, recorded occupations and recent member profiles, or add genuine employer Job Orders. Free registration includes 10 starter AI credits, as advertised on the recruiter signup page. Available actions and their credit requirements are displayed in the Platform. Registration does not itself create a subscription trial or unrestricted candidate access.
Before sending candidate interest requests, activating AusPath or receiving protected candidate information, the organisation must complete the applicable AusPath business verification and approval steps. AusPath may require evidence of a genuine employer relationship and role. Registration does not itself grant the Approved Recruiter badge or unrestricted access to candidate identity, contacts or documents.
Registration does not automatically create a paid subscription or an accepted placement assignment. Charges arise only under transactions and commercial terms the organisation accepts, subject to mandatory law.
3. Independent recruiter relationship, Recruiter Pro and AusPath Approved Recruiter badge
Independent relationship
The Recruiter remains an independent recruitment business responsible for its own staff, employer agreements, employer recruitment fees, representations, recruitment activity and compliance with applicable laws. Use of “Recruiter”, “Approved Recruiter” or participation in the AusPath network does not by itself create a legal partnership, joint venture, employment relationship or authority to bind AusPath.
Recruiter Pro — Powered by AusPath
Recruiter Pro is powered, operated and hosted by AusPath. Approved recruiter branding may appear in supported areas, but AusPath technology, infrastructure, branding elements, portals and AusPath-controlled URLs may remain visible. No custom domain, separately hosted instance, source-code licence or right to remove required AusPath attribution is included unless AusPath agrees in writing.
AusPath Approved Recruiter badge
After approval, AusPath may issue the Recruiter the AusPath Approved Recruiter badge for authorised display. The badge confirms only that AusPath has approved the organisation under its current due-diligence and participation process. It is not a government approval, employment-agent licence, labour-hire licence, migration authority, endorsement, guarantee of conduct or assurance of any candidate, recruitment, registration, sponsorship, migration, visa or employment outcome.
The badge remains AusPath property, is non-transferable and revocable, must not be altered or used by another organisation, and may be withdrawn if approval expires, information becomes inaccurate, the account is suspended or terminated, the Recruiter ceases to meet participation standards, or these Terms are breached. The Recruiter must stop displaying it when AusPath directs.
4. Recruiter approval, verification and access boundaries
AusPath may verify the organisation’s legal identity, business registration, genuine recruitment purpose, representative identity and authority, employer relationships, Job Orders, candidate-handling practices, licences and supporting evidence. The Recruiter must provide accurate, current information and notify AusPath of relevant changes.
AusPath may approve, reject, defer, condition, suspend or reinstate approval where reasonably necessary to protect candidates, employers, other recruiters, proprietary technology, security, legal compliance and the integrity of the AusPath network.
Candidate identity, contact details, documents and protected information remain subject to Platform permissions, candidate consent and workflow stage. Approval does not create unrestricted database access.
5. Purchased AI credits and fair use
AI credits are purchased to cover AusPath’s AI processing costs and prevent excessive or automated misuse, keeping the Platform sustainable and fair for recruiters. Viewing a redacted candidate CV uses 1 AI credit. One completed Job Order AI matching run uses 1 credit, and one AI CV generation or regeneration uses 1 credit. Other eligible AI Recruiter Pro actions consume the credit amount shown in the Platform before the action. Saved match viewing, manual shortlisting and ordinary CRM navigation do not consume credits.
Credit bundle prices and GST treatment are confirmed at checkout before purchase. Purchased credits remain valid for two years from purchase. Credits are assigned to the company workspace, have no cash value and cannot be transferred. Buying or using credits does not override candidate consent, reveal protected contact details, confirm candidate availability or create a placement entitlement.
Use is recorded in the workspace ledger where available. A failed, duplicate or unsupported execution is not a completed billable action; a completed matching run can use a credit even if no suitable candidate is found. AusPath will correct verified duplicate or erroneous charges. Refund rights required by law remain unaffected.
6. Candidate profiles, Job Orders, AI matching, shortlists and AI CVs
Candidates build their profiles through the candidate portal, recording their qualifications, experience and other relevant information and using available preparation tools. Candidate-entered information and a Workforce Readiness Score are not independent verification of qualifications, suitability or work rights.
Recruiters may explore candidate types before identifying an employer opportunity. Job-specific matching and interest requests must relate to a genuine employer and Job Order with accurate role requirements, location, profession, mandatory criteria and positions available. The Recruiter must not create false opportunities to inspect candidates or represent an unconfirmed candidate as ready or available.
AusPath’s matching technology may analyse permitted candidate CV content, structured profile information, profession, skills, experience, pathway stage, Workforce Readiness Score, preferred location, availability and Job Order criteria. It may rank candidates and identify relevant strengths, gaps and missing evidence. A score is an aid to review, not a guarantee of suitability, registration, work rights, visa eligibility or employment outcome.
Candidate results remain redacted until the permitted progression stage. AI-generated or job-specific CV drafts must use recorded candidate information and must not invent qualifications, experience, registration or evidence. A job-tailored CV requires review and approval as employer-safe before any employer-facing publication; a missing or unapproved CV must not be shown as ready. The Recruiter remains responsible for reviewing AI output and making lawful professional and hiring decisions.
7. Candidate interest, Activate AusPath and the recruitment workflow
Recruiter Pro is a controlled recruitment environment, not an open candidate database. Candidate identity, contacts and documents are released only as permitted by candidate consent, the Job Order, recruiter approval and the applicable workflow stage.
- Create a Job Order. The Recruiter records the genuine employer, role, requirements and relevant employer contract/payment terms.
- AI Matching. The Recruiter runs matching against the Job Order and reviews the results.
- Shortlist. The Recruiter selects potentially suitable candidates and reviews permitted profile and CV information.
- Send Interest. The authorised Platform workflow sends an interest request for the relevant role.
- Interest Confirmed or Declined. The candidate’s response is recorded. A declined or unconfirmed candidate does not progress as a confirmed-interested candidate.
- Activate AusPath. The Recruiter requests AusPath’s involvement. AusPath reviews the role and decides whether to accept it. The service scope, fee split and payment terms must be agreed before AusPath undertakes the assignment.
- AusPath Candidate Checks. For an accepted assignment, AusPath verifies the candidate’s information and suitability against the role within the agreed scope, identifying gaps or further evidence needed.
- First Interview. AusPath arranges the first suitability interview with the candidate and Recruiter, with AusPath participating.
- Employer Interview. An employer interview is arranged for candidates who progress, with the Recruiter managing the employer relationship and AusPath coordinating the candidate side.
- Employment Contract. If the employer and candidate agree, the employment contract is signed. The employer remains responsible for its employment offer and contractual obligations.
- Onboarding and Coordination. After selection and offer acceptance, AusPath manages agreed candidate onboarding, documentation and, where applicable, visa-processing coordination through appropriately authorised professionals and relevant recruitment partners.
The Recruiter must not scrape, harvest, export, independently solicit or retain protected AusPath candidate information outside the permitted workflow. Candidate interest, an interview, verification or a signed employment contract does not guarantee sponsorship, visa approval or commencement.
8. Assignment acceptance, split fees and candidate onboarding
Agree the assignment before work begins
AusPath decides whether it can accept a proposed assignment. Selecting “Activate AusPath” is a request, not automatic acceptance. Before AusPath begins the assignment, the parties must agree the relevant Job Order, employer terms, service scope, fee base, fee split and payment arrangements in writing. No fixed fee-split percentage is imposed by these general Terms.
Recruiter and AusPath responsibilities
The Recruiter sources and manages the employer, obtains a genuine Job Order, manages employer communications, interviews and offers, and remains responsible for its employer agreement. AusPath supplies candidates through its Platform, undertakes the agreed candidate checks and first interview, coordinates introductions and manages agreed onboarding after selection and offer acceptance.
Fee base, progress payments and receipts
The accepted Job Order agreement must identify the employer recruitment fee to be shared, any agreed exclusions or deductions, each party’s share, invoicing responsibility, payment milestones and the deadline for remitting each share. Where the employer contract provides staged or progress payments, the agreed shares follow those relevant milestones and actual employer receipts as recorded in the Job Order agreement. The parties must agree how cancellations, non-payment, refunds, rebates and replacements affect their respective shares before the assignment is accepted; no automatic replacement or refund promise is created by these general Terms.
Recruitment Network Partner
If an intermediary Recruitment Network Partner is involved, its applicable fee, the calculation basis, who pays it and any deduction before the remaining fee is split must be disclosed and agreed in writing as part of the accepted assignment. No network fee is automatically added by these Terms.
Onboarding and third-party costs
AusPath’s candidate services are those included in the accepted split-fee scope. These Terms do not automatically add the previous fixed Job Order activation, candidate-unlock, monthly AI Pro or separate fixed onboarding tariff to a new split-fee assignment. Any additional service or cost must be separately agreed before it is incurred.
Migration/legal, government and third-party fees are separate unless expressly included. Regulated migration advice and legal services must be supplied by appropriately authorised professionals under their own applicable terms. Where Philippine recruitment processes apply, relevant job-order, licensed-partner and accreditation requirements must be met for the assignment. These Terms do not represent that any particular accreditation, job order or visa is already approved.
Existing transactions and service boundaries
Existing accepted transactions are not retrospectively cancelled or repriced by this revised model. Their applicable terms continue unless the parties agree otherwise. The Recruiter remains responsible for warranties, rebates and replacement promises it makes to its employer; AusPath is bound only by its accepted scope and terms. Any remedy is subject to that agreement and applicable law.
9. Recruiter workspace and AI Recruiter Pro
Your recruitment workspace
Subject to approval and permissions, the Platform supports employer and Job Order records, candidate discovery, AI matching, redacted shortlists, interest requests, interviews, placement progression, communications and reporting. Candidate privacy and release controls continue throughout the workflow.
Find employers for the candidates you discover
AI Recruiter Pro is an additional employer-research and CRM capability. Recruiters may use it to research employers with relevant hiring activity, manage employer opportunities, record calls and emails, and organise follow-ups. It may support campaign pipelines, tasks, connected email and calendar capabilities and AI-assisted work, subject to available integrations, individual authorisation, source limits and data quality. Eligible AI actions use purchased credits at the amount displayed before execution.
Employer research does not establish a confirmed vacancy, employer agreement or candidate fit. When approaching an employer, the Recruiter must accurately describe an opportunity as potential until the employer’s requirements and candidate’s interest, availability and suitability have been checked. AusPath does not guarantee a daily lead quantity, a lead response, a Job Order or revenue.
Connected email and calendar services remain subject to their provider terms and the permissions granted. Outreach remains subject to human review and applicable consent and messaging rules. No trial-to-subscription conversion, seat allowance or recurring fee is created by these general Terms; any separately offered paid service requires its own accepted order.
10. AI controls, human review and service boundaries
AI functions operate only within the authorised user’s current workspace permissions and available data. The Recruiter remains responsible for instructions, approvals, lawful authority, recipients, external use of generated content and all professional, employment and hiring decisions.
- AI output may be incomplete or wrong and requires appropriate human review.
- AI must not invent candidate status, evidence, qualifications, employer interest, professional registration or migration eligibility.
- AI does not make legal, migration, registration, sponsorship or final hiring determinations.
- Unsupported or disconnected functions must not silently run or charge.
11. External connections, communications and provider terms
You authorise use of each connected email, calendar, CRM, job-board or other provider only within the permission you grant and the approved Platform action. You must hold the required account, subscription, authority and lawful basis and comply with provider terms.
You are responsible for lawful recipient selection, sender identification, consent or other lawful authority, content approval, unsubscribe facilities, suppression and compliance with applicable spam, privacy, employment, anti-discrimination and consumer laws. You must not use Recruiter Pro for deceptive messages, purchased-list spam, harassment, uncontrolled bulk messaging or unauthorised scraping.
Third-party providers may change APIs, permissions, prices, availability and rate limits. AusPath does not guarantee uninterrupted third-party access. External subscriptions and provider charges remain your responsibility unless expressly included.
12. Privacy, candidate consent and security
Each party must handle personal information lawfully, securely and only for authorised recruitment and service purposes. AusPath’s Privacy Policy explains its collection, use, disclosure, storage, overseas handling and individual-rights practices.
- Recruiter access must be limited to authorised users who need it.
- Candidate contact details remain protected through controlled workflows and are not sold or released as a standalone list.
- Sensitive documents and migration-related information may have additional access restrictions.
- The Recruiter must remove users whose authority ends and promptly report suspected compromise.
- The Recruiter must not export, copy, disclose or retain candidate information beyond the permitted purpose.
- Candidate consent, visibility, interest responses, document access and relevant revocations may be logged.
Protected AusPath Candidate data is not a recruiter-owned database.
13. Workspace administration, licensing and acceptable use
The organisation administrator is responsible for users, roles, billing authority, connections and settings. Each user must have a unique account and protect credentials.
AusPath approval is not a government licence, employment-agent licence, labour-hire licence, migration registration or authority to perform regulated work. The Recruiter must identify, obtain and maintain every licence, registration, permit and professional authority required wherever it operates.
You must not reverse engineer, disrupt, overload, probe, bypass controls, share accounts, introduce malicious code, access another workspace, scrape protected profiles, manipulate credits or activations, impersonate another person, discriminate unlawfully, create false Job Orders, circumvent fees or use the Platform unlawfully.
14. Cancellation, suspension, termination and accrued fees
Cancellation
The Recruiter may request cancellation of an assignment or account through the published support channel. The effect on an accepted assignment, services already performed and accrued fee shares is determined by the accepted Job Order agreement and applicable law. If a separate recurring service has been expressly ordered, future renewal may be cancelled through available account controls or the published support channel under that order. Cancellation does not erase a purchased-credit transaction, an accrued agreed fee share or another charge already incurred. Access to free features may continue subject to organisation approval, security and Platform rules.
Suspension
AusPath may restrict or suspend access where reasonably necessary because of candidate risk, suspected Platform or candidate abuse, privacy or security concerns, unlawful conduct, non-payment, credential compromise, licensing concerns, false information or Job Orders, attempted circumvention of protected workflows or fees, or an actual or suspected breach of these Terms.
Termination
AusPath may terminate recruiter access, approval, badge permission and associated entitlements for material breach, fraud, candidate exploitation, deliberate privacy/security abuse, unlawful conduct, serious professional misconduct, non-payment, loss of required authority, materially false verification information or serious candidate, employer, legal, security or platform-integrity risk.
Termination does not erase accrued payment obligations, completed transactions, candidate consents, confidentiality duties, intellectual-property protections or provisions intended to survive termination.
15. Payments, GST, refunds and disputes
Unless expressly stated otherwise, commercial amounts are in Australian dollars and exclude GST. A checkout or accepted Job Order agreement confirms the exact GST treatment and amount before payment. The Recruiter authorises AusPath and its payment provider to charge only purchased AI credits and other charges expressly accepted by the organisation. Split-fee invoices and remittances follow the accepted Job Order agreement; accepting these Terms alone does not authorise an unspecified charge or recurring payment.
Refunds are provided where required by law, where an accepted transaction-specific promise applies, or where AusPath confirms a duplicate or erroneous charge. Cancellation of a future subscription renewal does not automatically reverse a valid past transaction or completed service. Nothing removes a statutory refund or remedy that cannot lawfully be excluded.
Billing disputes should be raised promptly through the published support channel with the relevant workspace, transaction and reason.
16. Service limits, consumer guarantees and liability
The Platform depends on internet access, third-party providers, user and candidate data, changing circumstances and human decisions. AusPath does not warrant uninterrupted availability, that every profile is complete, that every AI output is accurate or that Platform use will produce a particular commercial or recruitment result.
Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded. Where a statutory guarantee applies and liability may lawfully be limited, AusPath’s liability is limited, at its option, to resupplying the affected service or paying the reasonable cost of resupply.
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, or loss of profit, revenue, opportunity, goodwill or anticipated savings arising from the Platform. This does not limit liability that cannot lawfully be limited or liability for fraud, wilful misconduct, breach of confidentiality or unlawful misuse of personal information.
To the maximum extent permitted by law, AusPath’s aggregate liability arising from affected Platform services in a 12-month period is limited to the fees paid by the Recruiter for those affected services during that period. This cap does not apply where law prohibits it.
17. Intellectual property, candidate network, scoring and feedback
AusPath retains ownership of the Platform, software, source code, URLs and domains, infrastructure, portals, matching algorithms, workflows, AusPath branding, templates, scoring methods, Workforce Readiness methodology, candidate ecosystem and documentation. Recruiter Pro access does not transfer ownership of AusPath technology or the candidate network.
The Recruiter receives a limited, revocable, non-transferable right to use Recruiter Pro for authorised business recruitment purposes while the account remains in good standing. The Recruiter must not copy, extract, resell, reverse engineer or use Platform data or outputs to recreate a competing candidate database, matching system or scoring method.
The Recruiter retains ownership of its pre-existing business name, logo, content and recruiter-controlled records, subject to candidate rights and permissions required for service delivery.
18. Changes, notices and governing law
AusPath may update these Terms for legal, security, provider, pricing or product changes. Material changes will receive reasonable advance notice and apply prospectively. A pricing change does not retrospectively alter a fee already triggered under the accepted terms applying to that transaction.
Operational notices may be delivered in Recruiter Pro or to the administrator email. The Recruiter must keep contact details current.
These Terms are governed by the laws of Victoria, Australia, and the parties submit to courts with jurisdiction in Victoria, subject to any mandatory law or right permitting proceedings elsewhere. If a provision is unenforceable, it is read down or severed without affecting the remainder. Failure to enforce a right is not a waiver.
19. Contact and continuing acceptance
Questions, cancellations, billing disputes, privacy requests and notices may be submitted through the AusPath Enquiry Form or the recruiter workspace support channel.
By registering, accepting a transaction or continuing to use the Platform after these Terms take effect, the Recruiter confirms it has read and accepted the applicable Terms and any checkout-specific conditions.
